The below Terms & Conditions and our terms of use apply to any account user placing orders with us to submit equipment for recycling.
The consumer must be the legal owner or have the owner’s full permission to sell the equipment(s) sent to us.
Once their phone is received ownership of the equipment will pass to us.
Input of details of the equipment to be sold by you to us is an offer on the consumer's behalf to enter into a binding contract to sell their equipment to us for the purposes of recycling/resale, which we are free to accept or decline at our absolute discretion. Acceptance of the offer and the provision of our services in this regard will commence upon receipt by us of their equipment at our warehouse
The consumer may cancel a sale by notifying us in writing (by email) of their intention to do so at any point prior to receipt by us of their equipment. Thereafter, we shall have commenced the provision of our services to them and are unable to accept any cancellations or return any equipment to them after this time.
These terms & conditions do not affect any of the consumer's statutory rights, which cannot be excluded or restricted at law.
We shall not be responsible for losses that result from a failure to comply with these Terms & Conditions, including, but not limited to, losses that fall into the following categories:
This shall not prevent claims for foreseeable loss of, or damage to, any physical property or any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.
If you or the consumer have cause for complaint regarding any service or product provided by the GO-SIM website please email full details to recycling@gosim.com.
We endeavour to respond to all complaints within two working days and aim to resolve any problems as soon as we can after receiving details of a complaint.
We grade old mobile phones once we receive them by reference to the following categories. It’s important to stick to the guide on the website as incorrect entries will affect the price paid as part of this contract.
In respect of a full working phone with a battery a full offer price (as detailed on the applicable price list from time to time) will be paid.
Non working handsets (examples of which are set out below) will be graded and paid from a reduced price list. Please note that the examples given below are a non-exhaustive list of defects which will result in a reduced price being paid. We reserve the right to pay such reduced price in respect of any equipment which we (acting reasonably) determine to be non-working.
No payment is made for handsets that are beyond economic repair (examples of which are set out below). Please note that such examples are a non-exhaustive list of defects which will result in no payment being made. We reserve the right not to make payment in respect of any equipment which we (acting reasonably) determine to be beyond economic repair.
Each mobile phone is tested at our warehouse to ensure the information provided by you is accurate. All phones are tested and recycled in line with ISO 9001 and 14001 procedures
GO-SIM fully adheres to the Waste Electrical and Electronic Equipment Directive (WEEE Directive).
If any court or competent authority decides that any of the provisions of these Terms & Conditions are invalid, unlawful or unenforceable to any extent, the provision will, to that extent only, be severed from the remaining term, which will continue to be valid to the fullest extent permitted by law.
If we fail, at any time while these terms & conditions are in force, to insist that the consumer perform any of their obligations under these terms & conditions, that will not mean that we have we have waived such rights or remedies and will not mean that the consumer does not have to comply with those obligations. If we do waive a default by the consumer, that will not mean that we will automatically waive any subsequent default by this consumer. No waiver by us of any of these Terms & Conditions shall be effective unless we expressly say that it is a waiver and we tell the consumer so in writing.
A person who is not a party to these terms & conditions shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you and the consumer accept that communication with us will be mainly electronic. We will contact the consumer by email and, for contractual purposes, they agree to this electronic means of communication and acknowledge that all contracts, notices, information and other such communications that we provide to them electronically comply with any legal requirements that such communications be in writing. This condition does not affect their statutory rights.
All notices given by them to us must be sent to the contact details specified in clause 3.1 of these terms & conditions. Notice will be deemed received and properly served 24 hours after an e-mail is sent or three days after the date of posting of any letter. In proving service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of that addressee.
